Privacy Policy

This Privacy Policy applies only to WatchTheYard.com (however accessed and/or used, whether via personal computers, mobile devices, or otherwise), which is owned or controlled by Watch The Yard LLC. (“Company,” “we,” “our” or “us”) or other interactive features that are accessible or downloadable through WatchTheYard.com and that post a link to this Privacy Policy (collectively, the “Web Site”). This Privacy Policy only covers information collected at the Web Site, and does not cover any information collected at any other web site or offline by Company (unless specifically stated).

Please read this Privacy Policy carefully. In addition, please review our Terms of Use, which govern your use of the Web Site and the content you submit to the Web Site, respectively.

TYPES OF INFORMATION THAT MAY BE COLLECTED

The following are the types of information we may collect:

Information You Provide Us
We may ask you to provide us with two types of information: (1) personal information, which is information that could reasonably be used to identify you personally, such as your name, e-mail address, cell phone number and physical address (“Personal Information”); and (2) demographic information, such as gender, zip code, information regarding your education or number of children, or similar information. We may collect this information at various places and forms on the Web Site. We may receive information about you from other sources; for example, we may receive information from a marketing partner in connection with a co-branded web site or promotion. Information We Collect As You Access And Use The Web Site
We may receive and store certain types of web site usage information whenever you visit or interact with the Web Site. For example, we and our third party service providers may collect the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other similar information. We may also collect your IP address or some other unique identifier for the particular device you use to access the Internet, as applicable (collectively referred to herein as a “Device Identifier”). A Device Identifier is a number that is automatically assigned to your computer, your cell phone, or other device used to access the Internet (each, a “Device”), and our computers identify your device by its Device Identifier. When analyzed, web site usage information helps us determine how our site is used, such as what types of visitors arrive at the Web Site, and what type of content is most popular. Cookies
The Web Site uses standard technology called “cookies,” which are small data files that are transferred to your Device when you visit the Web Site if your browser is set to accept cookies. Cookies automatically identify your web browser to the Web Site whenever you visit the Web Site, and may make navigating and using the Web Site easier for you and allow you to personalize your experience on the Web Site. Web Beacons
The Web Site and any communications sent by the Web Site may contain electronic images (generally, single-pixel “.gif” images) called “web beacons.” These web beacons allow Company and third parties to monitor and collect certain information about the viewer of the web page, web-based document, e-mail message, or other communication, such as the type of browser requesting the web beacon, the Device Identifier of the Device that the web beacon is sent to and the time the web beacon was viewed.

Embedded Scripts
An embedded script is programming code that is designed to collect information about your interactions with the Web Site, such as the links you click on. The code is temporarily downloaded onto your Device from our Web server or a third party service provider, is active only while you are connected to the Web Site, and is deactivated or deleted thereafter.

IMPORTANT NOTICE REGARDING PUBLIC AREAS OF THE WEB SITE AND USER CONTENT

If you register to join the Web Site (“Member“), you may be able to create a public profile that includes information such as your photo, username, city/state and other information that you choose to post publicly (“Profile“). The Web Site may also publicly post information about your activity on the Web Site as a Member, such as when you post information, such as a blog entry or message board post, to the Web Site.

The Web Site may contain public areas to which you can contribute your original text and audio or video content, such as comments the message boards, blog comments areas, personal blog, online chat features, and the public portion of your Profile (collectively, “Public Areas“).If you submit comments, message board posts, blog comments, votes, reviews, suggestions, chat messages, photographs, videos, audio recordings, music, text or other content other content to Public Areas (“User Content“), it may be published online or offline in any media or format (currently existing or later developed). Other users of the Web Site will have access to your User Content and may have the ability to share it with third parties across the Internet, including through the use of Web Site features allowing users to share links to User Content with third party web sites (such as Blogger, Facebook, Twitter and similar sites). Company may use your User Content, or any portion, for advertising, marketing, publicity and promotional activities. If you submit to Company and/or the Web Site any User Content including comments, message board posts, blog comments, votes, reviews, suggestions, chat messages, photographs, videos may be published online or offline (including, without limitation, on The Doctors Show, on a CD or DVD, or any other electronic or non-electronic media or format currently existing or later developed). We may publish your name, voice, likeness and other Personal Information in connection with publishing the User Content or any thereof, and we may use the User Content and any excerpt thereof in connection with advertising, marketing, publicity and promotional activities. You also may have the ability to interact and communicate other Members on the Site. Please use caution when interacting and communicating with people that you do not know personally. Please note that Company cannot ensure the security of any information you choose to make public and cannot ensure that parties who have access to such publicly available information will respect your privacy. Therefore, use caution when including Personal Information in User Content or a Public Area or any message that you send using the Web Site (for example, do not post your real name, e-mail address, phone number or physical address).

HOW WE USE THE INFORMATION COLLECTED

Company may use information collected through the Web Site, including your Personal Information: (1) for use on or in connection with Web Site; (2) to process your registration with the Web Site, including verifying that your e-mail address is active and valid; (3) to provide you with information or services or process transactions that you have requested or agreed to receive; (4) to allow you to participate in the Public Areas and other features of the Web Site; (5) to improve the Web Site or our services and for internal business purposes; (6) to contact you with regard to your use of the Web Site and, in our discretion, changes to the Web Site policies; and (7) for purposes disclosed at the time you provide your Personal Information.

Please note that information submitted to the Web Site via the comments area or other similar mechanisms will not necessarily receive a response.

If you send a friend a communication from the Web Site, the information you provide (names, e-mail addresses, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain consent from that person.

THIRD-PARTY AD SERVING AND AUDIENCE AND TRAFFIC MEASUREMENT SERVICES
The Web Site may use third party network advertisers to serve advertisements on the Web Site and may use a traffic measurement service to analyze traffic on the Web Site. Network advertisers are third parties that display advertisements based on your visits to the Web Site and other web sites you have visited. Third-party ad serving enables us to target advertisements to you for products and services in which you might be interested. Although advertisers and other companies do not have access to cookies set by the Web Site, the Web Site’s third party ad network providers, the advertisers, the sponsors, and/or traffic measurement services may themselves set and access their own cookies on your Device if you choose to have cookies enabled in your browser or they may otherwise have access to non-personal information. These third party cookies are set to, among other things, help deliver advertisements to you that you might be interested in, to prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. Third party cookies and web beacons are governed by each third party”s specific privacy policy, not this one.

WITH WHOM INFORMATION MAY BE SHARED
We do not share your Personal Information with third parties for those third parties’ marketing purposes unless you opt-in to such sharing at the time you provide your Personal Information. We may share non-personal information, such as aggregate user statistics, demographic information, and web site usage information with third parties. In addition, we may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Third parties providing services on our behalf
We employ third parties to perform functions on our behalf; examples include hosting or operating the Web Site, sending e-mail and/or other communications, providing wireless services, removing repetitive information from customer lists, data analysis, marketing assistance, and customer service. These third parties may have access to your Personal Information for the purpose of performing such functions on the Web Site’s behalf.

When You Agree To Receive Information From Third Parties
You may be presented with an opportunity to receive information and/or marketing offers from third party(s). If you do not agree to have your Personal Information shared, your Personal Information will not be shared with such third party(s) for direct marketing purposes. Sweepstakes, Contests and Promotions
We may offer sweepstakes, contests, and other promotions (“Promotion”) through the Web Site that may require registration. If you choose to enter a Promotion, your Personal Information may be disclosed to third parties in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. Business Transfers

UPDATING YOUR INFORMATION AND OPTING OUT FROM EMAIL COMMUNICATIONS
The Web Site may contain web pages through which you can correct or update some of the personal information you have provided to us through registration with the Web Site. With regard to e-mail newsletters and similar communications you may receive from us, you may tell us you no longer want to receive these emails from the Web Site by following the opt-out instructions provided to you in those communications. Please note that we reserve the right to send you certain communications relating to your account or use of the Web Site, such as administrative and services announcements and these transactional account messages may be unaffected if you choose to opt-out from marketing communications.

THIRD PARTY CONTENT AND LINKS TO OTHER WEB SITES
When you are on the Web Site you may be directed to other sites that are operated and controlled by third parties that are beyond our control. For example, if you “click” on a banner advertisement, the “click” may take you off the Web Site onto a different web site. This includes links from advertisers, sponsors and partners that may use the Web Site’s logo as part of a co-branding agreement. These other web sites may set their own cookies on your browser, independently collect data or solicit Personal Information and may or may not have their own published privacy policies. If you visit a web site that is linked from our Web Site, you should consult that web site’s privacy policy before providing any Personal Information. Company is not responsible for the privacy practices employed by any third party web site.

CONSENT TO TRANSFER
The Web Site is operated in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Web Site or providing us with any information, you consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

SECURITY
Company incorporates commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, or wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that Company cannot ensure or warrant the security of any information you submit via the Web Site, and you do so at your own risk.

A SPECIAL NOTE FOR PARENTS CONCERNING PRIVACY
The Web Site is a general audience web site. We do not knowingly collect any Personal Information from children younger than the age of thirteen (13) on the Web Site and we will delete any information later determined to be from a user younger than thirteen (13).

NOTIFICATION OF CHANGES AND YOUR ACCEPTANCE OF THE PRIVACY POLICY
By using the Web Site, you acknowledge your agreement to the terms of this Privacy Policy. From time to time, Company may update this Privacy Policy and those changes will become effective immediately upon posting. However, Company will use your Personal Information in a manner consistent with the Privacy Policy in effect at the time you submitted the information, unless you consent to the new or revised policy.
